Marlota offers the products exclusively to end users to purchase merchandise without the intention of resale.
“End user” is understood to be any natural or legal person who acts within www.marlota.es for purposes other than those inherent to the commercial, business or professional activities that they normally carry out.
Marlota reserves the right not to attend to orders made by subjects that differ from the end user. Only those end users who have registered therein in accordance with the provisions of these General Conditions may acquire goods and services marketed through the website.
The products we present on our website are a careful selection from our collection. We have taken special care to display the colors and characteristics of our products with great precision. Of course, each monitor's calibration is different, and we cannot guarantee that your monitor displays colors accurately.
- REQUIREMENTS FOR REGISTERED USERS

- CONTRACT AND ACCEPTANCE OF ORDERS
The content of our website is an invitation to do business. Until your order is accepted by us (even if your account has already been charged) no contract will exist between you and us. If your order is not accepted and we have already charged you, the amount will be refunded in full.
After clicking “buy” you will receive a registration email. This does not imply that the order has been accepted, since it is an offer that you make to us to make a purchase. Orders are subject to our verification and acceptance. We will confirm acceptance by sending you an email informing you that the order is being shipped (Shipping Confirmation). Only at this moment will the Contract between you and us be formalized.
Only the Marlota products listed in the Shipping Confirmation will be objects of the contract. We will not be obliged to supply you with any other products that may have been ordered until we confirm their shipment to you in a separate Shipping Confirmation.
The contract with Marlota may be made in Spanish or English at the user's choice.
Marlota may refrain from placing orders that do not present sufficient guarantees of solvency, or that turn out to be incomplete or incorrect, or in the event that Marlota products are not available, without liability to you or third parties. In any case, we undertake to inform you and if we have already charged you the amount of the order, we will proceed to refund the amount you have advanced.
For security reasons, you will not be able to place orders over €6,000 or containing more than 30 items within a period of 15 days. If you are interested in making purchases greater than said amount or amount, we invite you to contact our customer service by email: onlineshop@marlota.es.
- WITHDRAWAL OF THE CONTRACT
You may withdraw from the contract within the next 14 (fourteen) calendar days from the date of receipt of the order. You will be refunded for such Marlota products following our Return Policy. Under no circumstances will we refund shipping costs.
The right of withdrawal will be applicable as long as the Marlota products are returned in the same conditions in which you received them, along with their complete original packaging, labels and together with any accessories related to them.
We will determine if the Marlota products are in the same condition in which they were sent to you. Products that have been returned damaged, incomplete, deteriorated, used or dirty due to the customer's fault will not be refunded and will be made available to the sender and resent with postage due.
To exercise your right of withdrawal, we invite you to follow our Returns Policy.
- PRODUCT AVAILABILITY
You accept that the products offered by Marlota in its online store are subject to stock limits. All orders for Marlota products are subject to availability. If any product is not available once the order has been placed, we will inform you as soon as possible. At that time you can modify your order or cancel it.
Marlota reserves the right to modify the products offered on the website at any time without prior notice.
- PURCHASING PROCESS
The following procedure has been established for the purchase through the Marlota website, which can be made in Spanish or English.
The user must access the online store hosted on the Marlota website where the Marlota products that can be purchased through the aforementioned channel are listed with the following information:
- Product description, reference, size, characteristics, colors, composition and photography.
- Price by unit.
- Shipping costs.
- Conditions of validity of the offer, if applicable.
Once the Marlota product or products have been chosen, the user must add it to the basket included on the website, indicating the units they wish to purchase. If the user has a promotion code, it must be included at that time to benefit from the conditions that apply to it.

Once the user has entered their data, they will access Shipping Details, where they can review their shipping and billing data, modify them and request an invoice. - SHIPPING
We ship Marlota products through UPS and DHL.
Transportation costs for shipments and their prices.
For Spain and Portugal the shipping cost for each order will be:
- NATIONAL 1-2 business days free from €150
- ISLANDS 1-2 working days free from €150
For the rest of the countries the shipping rates will be the following:
- EUROPE 1-2 business days €30
- UK 2-3 working days €35
- USA and CANADA 2-4 business days €45
- REST OF THE WORLD 2-4 business days €90
Please note that transit times are estimates, and especially if they have to clear customs.
If you want to consult a specific destination, send us an email to onlineshop@marlota.es , and we will quote and confirm transit times for your shipment.
Once your order leaves our warehouses, you will be sent an email notifying you that your order has been accepted and is being shipped.
Orders will be sent to the delivery address that you have given us in your form, so it is important that you pay attention when covering the delivery address information. We will not be responsible if the delivery address is incorrect or incomplete.
You will be able to track the status of your order through your tracking number. In turn, the transport agency will notify you by email of the evolution of the transit of your order.
For security reasons, Marlota will not send any order to post office boxes or military bases, nor will it accept any order when it is not possible to identify the recipient of the order and their address.
If you choose Pay Pal as a payment method, once the order is placed, it is not allowed to make any type of change to the shipping address.
- DELIVERY PROBLEMS
You must notify Marlota of cases of non-receipt of orders greater than 10 business days.
If it is impossible for us to deliver, the courier company will contact you again to agree on a new delivery date.
When your order is delivered you must check that everything is in accordance with what was requested. If there is any discrepancy or problem with the order, you must contact Marlota at the contact email, onlineshop@marlota.es , within a period of 14 days, leaving us your personal information and order number reflecting the discrepancy or problem and we will contact you shortly to resolve the incident.
- TRANSFER OF RISK AND PROPERTY
The user acquires ownership of the Marlota products the moment they receive the shipping confirmation and the product leaves the warehouses. Responsibility for Marlota products will be transferred to the user at the time the order placed is delivered.
- PAYMENT, CURRENCY AND TAXES
Prices on our website are shown in euros for all countries.
In accordance with current legislation, any purchase made from our website will be subject to 21% Value Added Tax (VAT) or any other tax or fee applicable by virtue of the country of destination.
If you are a VAT taxable person (companies, entities, organizations...) residing in the European Union and possessing an intra-community NIF, they will be exempt from paying VAT), with an essential condition being the sending of said document by e-mail to: onlineshop@marlota.es .
If you reside outside the European Union, your purchase is not subject to VAT.
These orders will be sent with an official invoice stating the exact total of the merchandise purchased.
Customers will be responsible for paying local taxes and import duties at destination.
DHL will contact you once your order arrives at customs. Unfortunately, as it differs from country to country, we cannot estimate these charges or any possible delays. If in doubt, we recommend that you contact your local customs office.
Shipping costs will be added to the purchase summary before making payment.
When entering the online store, we give you the option to choose the country from which you are going to make the purchase so that you can see the prices of Marlota products according to the country. If at the time of purchase, you select a country other than the one in which you were viewing the products; The prices and shipping costs shown in the summary at the end of the order may vary.
Marlota reserves the right to modify the prices shown on the site without prior notice.
The price of the products will be the one stipulated at all times on our website, except in the case of obvious error. Although we try to ensure that all prices on the site are correct, errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, the order will be considered canceled and any amounts paid will be fully refunded.
We will not be obliged to supply the product(s) to you at the incorrect lower price (even if we have sent you the Dispatch Confirmation) if the error in the price is obvious and unmistakable and could have reasonably been recognized by you as the incorrect price.
The rights recognized by current legislation remain safe.
Marlota accepts payments by Visa, Mastercard and Maestro credit or debit cards, American Express, Union Pay, Shop Pay, Google Pay and Pay Pal.
To protect the security of payment by credit or debit card, we use secure payment systems. Confidential payment data is transmitted directly and in encrypted form (SSL) to the financial institution. When making the payment, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. Then it will connect with the issuing bank, which will authorize the operation.
Marlota complies with the regulations required by the different payment methods with which it is possible to make the purchase.
Marlota reserves the right to verify personal data and adopt the appropriate measures so that the merchandise is correctly delivered.
- RETURNS
To return a product you have 14 calendar days from the date of purchase.
When you receive an order, we attach a return form that you must fill out to make the return. In the event that the form has been lost, please contact onlineshop@marlota.es .
Marlota products must be returned in the same condition in which you received them, along with their complete original packaging, labels and along with any accessories related to them. The customer will be responsible for proving that the items have been returned, so we recommend that they always be sent through a system that certifies delivery for your safety.
It is essential that labels and packaging be kept intact.
If your return does not comply with the stipulated terms, you will not be entitled to receive any refund and we will send you the Marlota products freight collect.
If the recipient of the Marlota products is different from the person who made the payment, the refund will be made to the person who made the payment.
Returned Marlota products must be sent in a single delivery. We reserve the right not to accept Marlota products that belong to a single order, returned and delivered at different times. Once we verify that the Marlota products you return to us meet all the specifications of the Return Policy, we will send you an email informing you that the return has been accepted. Whatever payment system you use, the refund of the amount will be implemented as soon as possible but always within a period of 15 days following receipt of the returned product in our warehouses.
We will not be responsible for losses, delays or shipments to the wrong address of any product that you wish to return to us, so we recommend that you send it by certified mail or with return receipt.
You will be responsible for the costs of returning the product and in no case will we accept returns sent postage due.
Under no circumstances will we refund shipping costs.

If you have made the payment by transfer, to make the return you must attach an account number to the return form where the deposit can be made.
If you receive an incorrect order or defective product, please contact us immediately, within 24 hours, at the following email address: onlineshop@marlota.es , indicating the error or defect along with your personal data.
In the case of problems with packaging, you must notify the courier company at the time of receipt of the order.
We will proceed to carefully examine the returned product and will inform you by e-mail within a reasonable period of time whether it should be returned or replaced (if applicable). The return of the item will be made as soon as possible and, in any case, within 14 days following the date on which we send you an email confirming that the return or replacement of the non-conforming item is appropriate.
The amounts paid for products that are returned due to a defect or defect, when it actually exists, will be fully refunded, including the delivery costs incurred to deliver the item to you and the costs you would have incurred to return it to us. The return will be made in the same way that was used to pay for the purchase.
The rights recognized by current legislation remain safe.
- GIFT OPTION
We offer the possibility for you to send gifts through our website. If you have received an item as a gift, to make a return you will have to follow the usual procedure in our Return Policy . The refund amount will be refunded to the person who made the purchase and in the same payment method used.
- GIFT CARD
The Card is available in digital/email format on our website www.marlota.es, it can be paid through any of the payment methods accepted on www.marlota.es. Under no circumstances can it be paid with another gift card.
The balance available on the Card at any time is the difference between the balance available at the time immediately prior to making a purchase and the corresponding amount used to pay for such purchase. If the purchase exceeds the balance available on the Card, the difference may be paid through any payment method accepted on our website www.marlota.es
Products purchased with the Card at www.marlota.es are subject to the exchange and return policy of said website.
The gift card has no expiration date.
The Card is a bearer document. The responsibility for the use and custody of the Card corresponds exclusively to its holder. The Card will not be replaced in case of theft, loss, misplacement or deterioration, although MARLOTA reserves the right to replace the Card in case of a change in its format.
It may not be used for advertising or promotion purposes of products or services marketed by third parties other than the issuer of this Card.
The acquisition and/or use of the Card implies full acceptance of these general conditions.
- LIMITED EDITIONS
Marlota offers limited editions for sale, pieces conceived and produced exclusively for very small productions. Numbered collector's pieces, so you can know how many pieces of the item you are purchasing have been produced.
- PREORDER
If any of our pieces are sold out or out of stock, write to us and ask us at onlineshop@marlota.es , we can probably make it especially for you as a Preorder.
These orders are so custom made for you and are so personal that they do not allow changes. Although it may seem risky to order a custom-made garment online, for us it is a common practice that we carry out every day with great success.
- LIABILITY AND WAIVER OF LIABILITY
Nothing in these conditions of purchase excludes or limits our liability for (1) death or personal injury caused by our negligence, (2) fraudulent misrepresentation, (3) any other liability that cannot be limited or excluded by applicable law.
Subject to the preceding paragraph and to the extent permitted by law, we will not be liable for any economic losses (including loss of revenue, data, profits, contracts, business or anticipated savings) or loss of goodwill or reputation or losses for special or indirect damages suffered or incurred by you arising out of or in connection with these Conditions.
The provisions of this section do not affect your legal rights as a consumer, nor your right to withdraw from the contract.
- FORCE MAJEURE EVENTS
We will not be liable for any failure or delay in performance of any of our obligations under a Contract, the cause of which is due to events beyond our reasonable control ("Force Majeure Event").
Causes of Force Majeure will include any act, event, failure to perform, omission or accident that is beyond our reasonable control and will include in particular (without limitation) the following:
- Strikes, lockouts or other industrial action.
- Civil commotion, revolt, invasion, terrorist attack or terrorist threat, war whether declared or not) or threat or preparations for war.
